APL POTM/POTY Promotion Terms:
1. These are the terms for the APL/APL NZ Player of the Month (“POTM”) and APL/APL NZ Player of the Year (“POTY”) promotions.
2. To be eligible to win the APL/APL NZ POTM/POTY you must comply with these terms. The determination of compliance will be judged solely by the Australian Poker League (“the APL”).
3. These terms are subject to change without notice (as determined by the APL from time to time) and included as part of them is any relevant information about the APL/APL NZ POTM/POTY Promotion and any playing requirements set out by the APL. You should also refer to www.playAPL.com for further information.
4. In order to be eligible to participate in the APL/APL NZ Player Promotions you must:
a. Reside in Australia, New Zealand or otherwise be able to be reasonably contacted;
b. Subject to clause 4(b)(i) be at least eighteen (18) years of age;
i. Where any winning party is under twenty one (21) years of age the APL will determine the nature of the prize to be awarded if any of the prizes require a minimum age of twenty one (21) years (for example WSOP prize).
c. Have a valid APL ID number; and
d. Meet any other reasonable requirements the APL may impose from time to time.
5. Persons who are ineligible to participate in the APL/APL NZ POTM/POTY Promotions include:
a. Any APL/APL NZ director, shareholder and or manager and their family (which is limited to their parents, siblings, and spouse (including any de facto spouse)) and any children of the directors, shareholders or managers;
b. All persons currently employed by the APL/APL NZ franchisor or previously employed within a ninety (90) day period of any winnings and their family, which is limited to any spouse or de facto spouse or APL/APL NZ franchisor staff members and any of their children;
c. All APL/APL NZ franchisees (including any principals, directors or shareholders of the APL/APL NZ franchisee) or those previously an APL/APL NZ Franchisee within a ninety (90) day period of any winnings and their family, which is limited to any spouse or de facto and any of their children; and
d. Any other party which the APL considers unfit for any reason which includes reasons of a conflict of interest. Where the APL will determine the same to ensure that its interests and the APL/APL NZ POTM/POTY Promotions’ integrity is protected at all times.
6. For the purposes of the APL/APL NZ POTM/POTY Promotions an eligible person is defined as a person who meets these terms generally and complies with clauses four (4) and five (5) above (“an Eligible Person”).
Commencement of POTM/POTY Promotion
7. The APL/APL NZ POTM/POTY Promotion commences on 1 January 2011 and concludes at 31 December 2011. The APL reserves the right to commence and complete the APL POTM/POTY Promotion as and when it sees fit.
8. In order to be eligible to win any of the prizes in the APL/APL NZ POTM/POTY Promotion an Eligible Person must meet all relevant criteria for the APL/APL NZ POTM/POTY Promotion as seen on www.playAPL.com during the Promotion Period. The criteria and terms are currently:
For APL Player of the Month
i. the Eligible Person must play a minimum of ten (10) APL games in any one calendar month where (for this promotion) the best ten (10) results for any one APL player in the league for that calendar month will be relevant to be eligible to win;
ii. The Eligible Person must be registered as an APL member in their current state (where NZ is to be considered a ‘state’ for the purposes of these terms) of residence on www.playAPL.com;
iii. A minimum eight (8) of the best ten (10) results for each APL player must have been obtained in the state in which that player was registered as at the start of each calendar month;
iv. The highest APL leader board point scorer per state will be declared the POTM for each respective state; if no player has participated in ten (10) or more games within that calendar month then the POTM will be awarded to that player who has played the highest number of APL events within that calendar month.
v. An exception for WA where the POTM will be the highest ranked point scorer on the WA Pro League leader board which reflects permitted events only. A minimum of ten (10) APL games must still be played within the calendar month. If no WA player has participated in ten (10) or more games within that calendar month then the POTM will be awarded to that player who has played the highest number of APL events within that calendar month.
For APL NZ Player of the Month
v. Qualification requirements remain the same as per clauses 8(i) – (iv) for APL NZ. However in the event that there is no POTM qualifier for NZ (for whatever reason) then the highest ranked regular point scorer on the NZ leader board, having played a minimum of ten (10) games in that calendar month, will be declared POTM. If no NZ player has participated in ten (10) or more games within that calendar month then the POTM will be awarded to that player who has played the highest number of APL events within that calendar month.
For Player of the Year
iv. Qualification criteria:
a) One Eligible Person per state will be declared POTM winner and automatically qualify for POTY;
b) The winner from each State Championship will qualify for POTY. POTY events to be held from April 2011; and
c) The winner from each APL Poker Tour will qualify for POTY.
v. Upon qualifying for the POTY, that Eligible Person is excluded from any further qualification into POTY for the remainder of that calendar year.
vi. Should the POTY winner already be a current TeamAPL member then any TeamAPL prize package awarded will be carried over to the following calendar year.
9. Should there be any tie for any placing in any of the individual promotions as set out in these terms the following steps will be followed:
a. That tied player who has played a greater number of APL events for the relevant period will be the winner. Should there still be a tied situation, clause (b) below applies;
b. The total number of points earned in games will be averaged over the relevant period and the greatest average of points will be the winner. Should this again result in a tie, then clause (c) applies;
c. The tied player with the highest frequency of 1st place finishes for the relevant period will be the winner, Should this again result in a tie the same will be applied to 2nd place finishes and so on until a winner is determined. Should this again result in a tie for that placing, then clause (d) will apply.
d. e. The APL reserves the right to determine the winner by any means it deems appropriate from time to time.
10. Other than the age provision noted above at clause 4(b)(i) and that of 8 (vi), the prizes awarded for the APL/APL NZ POTM/POTY Promotion are non transferable and will not be varied, changed or redeemed for money or any other item.
11. All participants agree to the use by the APL of their photograph or other information and recording (“the Participants IP”) for the APL/APL NZ POTM/POTY Promotion or as otherwise determined by the APL. The participants also agree that they will have no claim against the APL for the use by the APL of the Participants IP, under copyright law or other relevant laws.
12. If for any reason the APL/APL NZ POTM/POTY Promotion is not capable of running as anticipated, for whatever reason (which may include infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures etc) the APL reserves the right to cancel, modify or suspend the APL/APL NZ POTM/POTY Promotion as it see fit.
13. The APL/APL NZ reserves the right to disqualify any participant engaging in inappropriate conduct, according to these terms or as determined by the APL/APL NZ from time to time.
13. For any APL Player, participant or Eligible Person to be able to participate in the APL games they must abide by the APL Rules and any other terms or rules relevant to any APL event. You agree to enter into any agreement and abide by its terms as a result of any winning of a seat into Team APL.
15. The APL will provide the relevant results for the APL/APL NZ POTM/POTY Promotion within 72 hours of them becoming available (or as otherwise determined by the APL) where such results will be final. The APL will not enter into any correspondence in relation to the same. Where the APL/APL NZ will make reasonable efforts to:
a. contact the {POTM via phone or email within 3-5 working days of the said 72 hour period concluding. Contact will be attempted via the contact details the Eligible Person has provided the APL.
17. The APL is not liable for any loss or damage that is suffered (including but not limited to indirect or consequential loss) for any personal injury suffered or sustained as a result of participating in the APL/APL NZ POTM/POTY Promotion or for accepting and using any of the prizes awarded.
